Confuorto Terms of/for Service
NOTICE: PLEASE READ THIS REPORT DISCLAIMER IN ITS ENTIRETY. BY ACCESSING, VIEWING, OR UTILIZING ANY RESEARCH, INVESTIGATIVE, OR CONSULTATIVE REPORT (COLLECTIVELY, “THE REPORT”) PROVIDED BY CONFUORTO CONSULTANCY INC. DBA CONFUORTO OR AEROSHIELD INC., YOU (“THE CLIENT”) AGREE TO BE LEGALLY BOUND BY THESE TERMS. THE USE OF ANY REPORT CONSTITUTES UNCONDITIONAL ACCEPTANCE OF THIS POLICY, REGARDLESS OF THE ABSENCE OF A PHYSICAL OR ELECTRONIC SIGNATURE.
1. NO WARRANTIES AND LIMITATION OF ACCURACY
All Reports are provided “AS IS” and “AS AVAILABLE.” Confuorto Consultancy Inc., Aeroshield Inc., and their respective owners, principals, officers, directors, employees, vendors, sources, and agents (collectively, “The Protected Parties”) make no representations or warranties, express or implied, regarding the accuracy, completeness, or timeliness of the information provided.
- Accuracy: We CANNOT and DO NOT guarantee 100% accuracy. Records may be missed (omissions) or incorrectly transcribed (misreports) due to human error, faulty public records, or third-party data failures.
- Results: We CANNOT guarantee favorable results or specific outcomes for the Client.
- Timeline: We CANNOT guarantee turnaround or completion times. Delays caused by court clerks, resource availability, file pull queues, or other external factors are beyond our control.
- Remedy: The Client’s sole and exclusive remedy for disputed findings is a one-time reinvestigation of the specific disputed data point at no additional cost.
2. CLIENT RESPONSIBILITY AND LAWFUL USE
The Client assumes all responsibility and legal risk for the use, dissemination, and distribution of the Report. It is the Client’s sole duty to ensure that their use of the information complies with all applicable local, state, federal, and international laws, including but not limited to:
- The Fair Credit Reporting Act (FCRA)
- The Foreign Corrupt Practices Act (FCPA)
- Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations.
3. BROAD INDEMNIFICATION AND HOLD HARMLESS
To the maximum extent permitted by law, the Client agrees to fully indemnify, defend, and hold harmless The Protected Parties (including Confuorto Consultancy Inc., Aeroshield Inc., and all owners and agents) from any and all claims, demands, losses, liabilities, damages (including punitive, incidental, and consequential damages), and expenses (including, without limitation, reasonable attorney fees and court costs) arising out of or relating to:
- The use or misuse of the Report by the Client or any third party.
- Any inaccuracies, omissions, or misreports contained within the Report.
- Any violation of law or privacy rights resulting from the distribution of the Report.
4. FINANCIAL EXPOSURE AND REFUND POLICY
- Limitation of Liability: In no event shall the cumulative liability of The Protected Parties exceed the total service fee actually paid by the Client for the specific Report at issue.
- No Refunds: We maintain a STRICT NO REFUND POLICY. Fees are earned upon the commencement of research or investigative activities.
5. GOVERNING LAW AND JURISDICTION
This Disclaimer and all legal relations between the parties shall be governed by the laws of the State of Illinois. Any litigation, dispute resolution, or legal proceeding arising out of these terms or the services provided must be handled exclusively in the courts of Lake County, Illinois.
6. SUPREMACY AND SEVERABILITY
This Policy supersedes all other agreements, oral or written, prior or contemporaneous, regardless of signature status. No subsequent agreement shall override these terms unless that agreement specifically identifies this document by name (“Report Disclaimer – Confuorto Terms of/for Service“) and explicitly states the intent to exclude these protections. If any provision of this disclaimer is found to be unenforceable, the remaining provisions shall remain in full force and effect to maintain the “Shield” of protection for the agency.
